Buyers Beware:

Top things buyers should think about when buying a home. First off is a quick overview of the players.

  • Buyer, buyer agent, buyers personal lawyer-the good guys
  • Seller, Sellers Agent, Bank Lawyer, Home Inspector, Mortgage Company, Title Company, Insurance Company and more.  None of the latter wholly represents the buyers interests.

    Remember that there are 2 sides to a real estate transaction.  Make sure you keep privileged information to your self.  Don't assume that someone represents you no matter how nice they appear.

    Some Basics:

  • Buyers Agents represent the buyer only. 
  • Seller agents must disclose anything you tell them to seller
  • You get an affidavit from Certified Buyers Agents when you first meet      them which declares who the buyers agent represents
  • Oral Contracts don't apply to Real Estate in MA.
  • Earnest Money Deposits aren't always refundable
  • Deposits are normally held in non interest bearing escrow accounts
  •

  • Don't sign a Buyers Agency Contract with anyone-its not standard in the            industry. Leave yourself some options.
  • Don't put your social security number on contracts, offers, etc.
  • Avail yourself to free advice on line on how to boost credit scores
  • If renting now, make sure your security deposit was held in an escrow                  account. Its the law and it makes it easier to get your money.
  • Sellers must give you 10 days to inspect for lead paint
  • Sellers and sellers agents don't have to tell you in someone committed                     suicide in a house.
  • Mold is a lot simpler to test for than you think.
  • Radon Gas is the second leading cause of lung cancer after smoking                           Think you should check for radon gas-cost average is $35.00/ test kit.
  • Fax signatures were recognized as binding when Bill Clinton signed the bill            into law. Now esignatures can be agreed on as binding to parties.
  • The interest rate you are quoted is privileged info-not sellers business.

     A good Buyers Agent will help with advice, make for a good sounding board, offer considered opinions on market value and price and all the time they will be acting in your best interest.  They will help you with sales comp data that is accurate and useful. They will get to know you and won't waste your time with properties that don't meet your minimum guidelines, parameters, etc. And if there is competition among buyers for the same property, they will fight to get you the property and the best deal.
